APPEALS

I get many calls from people who do not like the order or judgment that a judge made. Their first reaction is to appeal that order. However, it is not easy to appeal an order or judgment simply because you did not like the order or judgment. In the vast majority of cases there must be a legal error made by the judge in order to have a judgment overturned. It is also important that when a case is tried the parties make an appropriate case, with appropriate objections during the hearing or trial, or the Court of Appeal may refuse to overturn the decision. As an appellate attorney it is certainly frustrating to me to handle an appeal in which I think that there was a clear error of law and the Court of Appeals denies the appeal because the proper objection or motion was not made during the trial or hearing. Therefore, it is important to have an experienced attorney both at your trial and add your appeal.
