RESTRAINING ORDERS

The breakup of a marriage is a very emotional and traumatic event. In many cases one or both of the parties may act out of emotion rather than out of reason. If the peace or safety of either of the parties is threatened a court may enter a Domestic Violence Restraining Order. In many cases it is important to have that restraining order in effect for a cooling off period after these separation. It is my philosophy that the restraining order should be limited and a permanent restraining order not be entered unless it is necessary. It is important to remember that if a permanent restraining order is issued there is a federal reporting requirement and if a parent has a security clearance it could affect that security clearance or employment. Therefore a permanent restraining order should be ordered when, and only when, that permanent restraining order is required.
